1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Storm of Intelligence (the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Definitions
- "Account" means your user or organization account used to access the Service.
- "Credits" means usage units that can be applied to eligible billable actions.
- "Paid Features" means features, plans, or usage that require payment.
- "Content" means data, prompts, files, and other material you submit to the Service.
3. Eligibility and Authority
- You must be legally able to enter into a binding agreement.
- If you use the Service for an organization, you represent that you can bind that organization.
- You must provide accurate account and billing information and keep it updated.
4. Account Security
- You are responsible for safeguarding credentials and account access.
- You are responsible for activity under your Account, including actions by authorized users.
- You must promptly notify us if you suspect unauthorized access or security compromise.
5. Service Scope and AI Output
The Service provides AI-assisted analysis, planning, and workflow tooling. AI output can be inaccurate, incomplete, or unsuitable for your use case.
- Output is provided for informational and operational support purposes.
- Output is not legal, financial, compliance, security, tax, or other professional advice.
- You are solely responsible for review, validation, and decisions made using output.
6. Acceptable Use
You must not:
- Use the Service for unlawful, fraudulent, infringing, or abusive activity.
- Attempt unauthorized access, data extraction, scraping, or denial-of-service activity.
- Bypass quotas, usage limits, credit controls, or security safeguards.
- Use the Service to build, deploy, or operate malware or harmful automation.
- Interfere with the Service, its infrastructure, or other users.
7. Monitoring, Abuse Detection, and Enforcement
We may use automated and manual controls to protect the Service, including rate limits, anomaly detection, fraud controls, abuse scoring, and security review.
- We may block, throttle, or reject requests that appear abusive, unsafe, or non-compliant.
- We may suspend or terminate Accounts for abuse, fraud, policy evasion, or legal risk.
- We may preserve and use logs and related records to investigate and enforce these Terms.
8. Paid Plans, Billing, and Payment Processing
Some features require payment. Payments may be handled by one or more authorized third-party payment processors. We may change processors at any time.
- Fees are shown before purchase and may include recurring or usage-based charges.
- You authorize us and our payment processors to charge your selected payment method.
- You are responsible for taxes, duties, and similar government charges unless stated otherwise.
- If payment fails or is reversed, we may limit or suspend Paid Features until resolved.
9. Credits and Promotional Balances
- Credits are a limited license for eligible Service usage and are not money or stored value.
- Credits are non-transferable and have no cash value.
- Except where required by law, credits and promotional balances are non-refundable.
- We may define and update credit rules, including issuance, top-ups, expiration, and action pricing.
- We may correct credit balances for billing errors, abuse, fraud, or technical issues.
10. Pricing and Product Changes
We may change pricing, plans, quotas, credit costs, feature packaging, and product functionality. Changes apply prospectively unless immediate changes are required for legal, tax, security, or abuse-prevention reasons.
- New prices are effective on the stated effective date or your next billing cycle.
- Continued use after the effective date means acceptance of updated pricing terms.
- Enterprise terms may be governed by separate signed agreements.
11. Renewals, Cancellations, and Refund Policy
- If a plan renews automatically, renewal charges apply unless canceled before renewal.
- Cancellation stops future renewals and does not retroactively cancel prior charges.
- Except where required by law, all payments are final and non-refundable.
- Except where required by law, no refunds are provided for consumed credits or delivered output.
- Custom enterprise refunds and credits, if any, are governed by written contract terms.
12. Chargebacks and Collections
- You agree to contact us first to resolve billing disputes when legally permitted.
- Fraudulent or abusive chargebacks, payment reversals, or repeated payment disputes may result in credit reversal, suspension, or termination.
- We may recover outstanding amounts using lawful collection methods.
13. Suspension and Termination
We may suspend or terminate access immediately for non-payment, abuse, fraud, security risk, legal compliance needs, or breach of these Terms.
- On termination, your right to use the Service ends immediately.
- Fees owed before termination remain due.
- Sections that should survive termination remain in effect.
14. Intellectual Property and Content License
You retain ownership of your Content. You grant us a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and use Content as needed to operate, secure, maintain, improve, and enforce the Service.
- We do not acquire ownership of your Content.
- We may use aggregated or de-identified usage data for analytics, quality, reliability, and product operations.
15. Third-Party Services
The Service may rely on third-party services, including model providers, payment processors, hosting providers, storage providers, and communication vendors. Their availability and policies are outside our direct control.
16. Availability and Support
We may modify, replace, pause, or discontinue any part of the Service at any time. We do not guarantee uninterrupted availability or specific response times unless stated in a signed agreement.
17. Disclaimer of Warranties
To the maximum extent allowed by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
18. Limitation of Liability
To the maximum extent allowed by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, business opportunities, or goodwill.
Our total aggregate liability for claims arising from or related to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the claim arose.
19. Indemnification
You agree to defend, indemnify, and hold harmless Storm of Intelligence and its affiliates, officers, employees, and contractors from claims, liabilities, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your Content, or breach of these Terms.
20. Governing Law and Jurisdiction
These Terms are governed by the laws of Poland, excluding conflict-of-law rules. Courts located in Poland will have exclusive jurisdiction unless mandatory law requires otherwise.
21. Updates to These Terms
We may update these Terms from time to time. Updated Terms will be posted with a revised "Last updated" date. Continued use after the effective date means you accept the revised Terms.
